01 — Agreement to These Terms

Using our website means agreeing to these Terms.

This website is operated by Felipe’s Fish. Throughout these Terms, “Felipe’s Fish,” “we,” “us,” and “our” refer to Felipe’s Fish.

By visiting our website, creating an account, placing an order, contacting us through the website, or otherwise using our online services, you agree to be bound by these Terms of Service and any additional policies referenced on the website.

If you do not agree with these Terms, you should not use the website or place an order through the store.

02 — Ecommerce Platform

Our online store is powered by Shopify.

Felipe’s Fish uses Shopify to provide the ecommerce platform through which products may be displayed, purchased, paid for, and managed.

Certain checkout, payment, fraud-prevention, account, and technology services may therefore also be subject to terms and policies maintained by Shopify or other service providers.

03 — Eligibility & Lawful Use

You must use our store lawfully.

By using the store or placing an order, you represent that you have the legal capacity to enter into a purchase agreement under the laws applicable to you.

You may not use the website, our products, or our services for any unlawful or unauthorized purpose or in violation of applicable federal, state, local, or other laws.

04 — Live Aquatic Animals

Livestock is naturally variable.

Fish, shrimp, snails, and other aquatic animals are living organisms. Individual animals may vary in size, color, pattern, markings, sex, temperament, maturity, and appearance.

Product photographs are intended to represent the species or variety being offered, but the exact animal received may not look identical to the photograph unless a listing specifically states otherwise.

Color and appearance may also change because of age, genetics, stress, aquarium lighting, diet, water conditions, social hierarchy, breeding condition, and other biological factors.

05 — Availability & Livestock Condition

Animal health takes priority over fulfilling an order.

Livestock availability may change without notice. Because we sell live animals, an item shown as available when an order is placed may later become unavailable or unsuitable for shipment.

We reserve the right to delay, remove, cancel, or refund an item if we determine that an animal is not healthy enough to ship, inventory is unavailable, weather or carrier conditions create an unreasonable shipping risk, or another issue could compromise animal welfare.

We do not substitute a materially different species or livestock item without customer approval.

06 — Prices & Product Information

Prices and availability may change.

Product prices, availability, descriptions, promotions, shipping charges, and other store information may change without prior notice.

We make reasonable efforts to present accurate information, but typographical errors, incorrect prices, inaccurate inventory, or other mistakes may occasionally occur.

If a material error affects an order, we may correct the error, contact you for instructions, adjust the order with your agreement, or cancel and refund the affected portion as appropriate.

07 — Orders

Submitting an order does not guarantee acceptance.

We reserve the right to accept, reject, limit, hold, or cancel an order when reasonably necessary, including because of livestock availability, animal health, suspected fraud, payment issues, shipping limitations, legal restrictions, pricing errors, or safety concerns.

If we cancel an order or an item that has already been paid for, the applicable amount will generally be refunded to the original payment method, subject to payment-provider processing times and applicable law.

08 — Billing & Account Information

Please provide accurate information.

You agree to provide current, complete, and accurate billing, shipping, contact, and account information when placing an order.

You are responsible for reviewing your order information before submitting payment and for keeping relevant account information current.

Incorrect billing, payment, email, phone, or shipping information may delay or prevent fulfillment.

09 — Shipping & Delivery

Live-animal shipping is subject to special conditions.

Shipping schedules, processing times, rates, carrier practices, weather holds, destination restrictions, tracking procedures, and customer delivery responsibilities are described on our Shipping page.

Delivery estimates are estimates and may be affected by weather, carrier operations, mechanical issues, natural disasters, service interruptions, or other circumstances outside our direct control.

Felipe’s Fish may delay a live-animal shipment before dispatch when we reasonably believe doing so is safer for the livestock.

10 — Receiving & Acclimating Livestock

Customers are responsible for preparing a suitable aquarium.

Before ordering livestock, customers should have an appropriately sized, properly filtered, cycled, temperature-stable aquarium suitable for the species being purchased.

Customers are responsible for monitoring tracking information, retrieving live-animal shipments promptly after delivery, and acclimating livestock appropriately.

Water quality, temperature, tank size, cycling status, aggression, compatibility, disease exposure, diet, and other aquarium conditions after delivery are outside Felipe’s Fish’s direct control.

11 — Live Arrival & DOA Claims

Problems at delivery should be documented immediately.

If livestock arrives deceased, customers should take clear photographs of the affected animal and shipping bag before disposing of the animal, bag, or relevant packaging.

Photo documentation and order information may be required to evaluate a dead-on-arrival claim.

Eligibility for replacement, store credit, refund, or other resolution is determined according to the applicable Felipe’s Fish policies and circumstances of the shipment, subject to rights provided by law.

12 — Returns, Refunds & Exchanges

Live animals are different from ordinary merchandise.

Because of animal welfare, disease-control, and biosecurity concerns, live aquatic animals generally cannot be returned or exchanged simply because a customer changes their mind.

Refunds, credits, replacements, and other remedies are subject to the applicable refund, shipping, and live-arrival policies, as well as any non-waivable rights provided by applicable law.

13 — Order Cancellations & Changes

Contact us as quickly as possible if something changes.

Customers may contact us to request an order cancellation or change before shipment.

Cancellation or modification requests are not guaranteed once an order has entered processing, livestock has been prepared, shipping labels have been created, or the shipment has been transferred to a carrier.

14 — Species Restrictions & Local Laws

Customers must confirm that livestock is legal in their location.

Laws and regulations governing aquatic animals vary by jurisdiction and may change over time.

Customers are responsible for verifying that livestock they purchase may legally be possessed, imported, received, or maintained at the delivery destination.

We reserve the right to refuse, adjust, or cancel an order when we reasonably believe shipping a particular animal to a destination would violate applicable law or carrier restrictions.

15 — Aquarium & Care Information

Care information is provided for general educational purposes.

Aquarium advice, compatibility information, species descriptions, acclimation guidance, and other care information provided through Felipe’s Fish are intended as general educational guidance.

Aquarium conditions vary significantly, and no general recommendation can guarantee a particular biological outcome.

Customers remain responsible for researching the needs of the animals they purchase and maintaining appropriate husbandry conditions.

16 — Website Content & Intellectual Property

Our website content may not be copied for commercial use.

Unless otherwise stated, the Felipe’s Fish name, branding, logos, graphics, original photographs, written content, page designs, and other original materials on the website are owned by or licensed to Felipe’s Fish.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, republish, sell, exploit, scrape, or distribute protected site content for commercial purposes without permission, except where permitted by law.

17 — Reviews, Photos & Customer Submissions

Please submit only content you have the right to share.

If you submit a review, photograph, testimonial, message, or other content for possible publication, you represent that you have the right to provide that content and that it does not unlawfully infringe another person’s rights.

We may moderate or remove content that is fraudulent, unlawful, abusive, misleading, infringing, spam, or otherwise inappropriate.

Customer content will only be displayed or used in accordance with applicable permissions, our Privacy Policy, and applicable law.

18 — Third-Party Services & Links

Some parts of our store rely on third parties.

Our website may use or link to services provided by Shopify, payment processors, shipping carriers, social platforms, analytics providers, or other third parties.

Third-party websites and services operate under their own terms, policies, availability, and practices. Felipe’s Fish does not control third-party websites or services and is not responsible for their independent content or practices except as required by law.

Your personal information is governed by our Privacy Policy.

20 — Prohibited Uses

We cannot guarantee specific biological outcomes after livestock has been delivered because aquarium conditions, handling, compatibility, water chemistry, disease exposure, temperature, feeding, and ongoing husbandry are outside our direct control.

Nothing in these Terms is intended to exclude, restrict, or waive consumer rights that cannot legally be excluded or waived.

23 — Limitation of Liability

Liability is limited where the law permits.

To the maximum extent permitted by applicable law, Felipe’s Fish and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or purchase of products where such damages may lawfully be limited.

This limitation does not apply where liability cannot legally be excluded or limited.

Nothing in these Terms limits any remedy or protection that applicable consumer law requires Felipe’s Fish to provide.

24 — Severability

The remaining Terms stay in effect if one provision is invalid.

If any provision of these Terms is determined by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate.

The remaining provisions will continue in effect.

25 — No Waiver

Failure to enforce a provision does not automatically waive it.

If Felipe’s Fish does not immediately exercise or enforce a right or provision under these Terms, that does not necessarily constitute a waiver of that right or provision.

26 — Termination

We may restrict access for serious misuse.

These Terms remain effective while you use the website.

We may suspend or terminate access to certain services when reasonably necessary because of fraud, abuse, unlawful conduct, security concerns, or material violations of these Terms.

Rights and obligations that by their nature should survive termination may continue after access ends.

27 — Governing Law

Felipe’s Fish operates from Connecticut.

To the extent permitted by applicable law, these Terms and transactions with Felipe’s Fish are governed by applicable United States federal law and the laws of the State of Connecticut, without regard to conflict-of-law principles.

This provision does not deprive consumers of mandatory protections provided by the laws that apply to them and cannot legally be waived by contract.

28 — Entire Agreement

Our published policies work together.

These Terms, together with the policies and terms referenced on the website that apply to a transaction, constitute the agreement between you and Felipe’s Fish regarding use of the store and applicable purchases.
